The Trial Board of Local 802, AFM, convened on April 22, 2002. Meeting called to order at 1 p.m. Present: members Goletz, Hood, Ray, Rojas, Schwartz and Singer. Members Koch, Lambert and Roberts absent.
Case # 921: Plaintiff Raul Azpiazu appeared before the board to present charges against Robert Hardwick and Shelly Gordon. The defendants did not appear due to ill health and were represented by Mrs. Beth Hardwick and office manager Annabelle Corke of the Bob Hardwick Sound office. Local 802 Business Representative Richard Schilio appeared on behalf of member Azpiazu and offered testimony as to the charges.
The defendants were charged with violating Local 802 bylaws: Article IX, Subdivision 1, Paragraph I; Article IV, Section 1, Paragraphs (gg), (ii), (uu), relating to the cancellation of an engagement, and discrimination due to age.
The Trial Board found and concluded (by a vote of 8-0) that the defendants had violated Article IX, Subdivision 1, Paragraph I of the bylaws of Local 802, relating to the cancellation of an engagement. The defendants were found not to have violated Article IV, Section 1, Paragraphs (gg), (ii), and that Article IV, Section 1, Paragraph (uu) was not applicable and so dismissed. The defendants were ordered to pay member Azpiazu $302.65, scale wages plus benefits, for the canceled engagement.
Case # 923: Plaintiff Robin Leder appeared before the board to present charges against defendant Robert W. Scott. Member Scott was charged with violating Article IX, Subdivision 1, Paragraph I of the bylaws of Local 802, relating to the cancellation of engagements.
The Trial Board found and concluded (by a vote of 8-0) that member Scott had violated Article IX, Subdivision 1, Paragraph I, and ordered that plaintiff Leder be paid $1,314.38, scale wages plus benefits, for the canceled engagements.
