Grievance Corner
Volume CV, No. 10October, 2005
Kaufman Center. The union brought a grievance against the Kaufman Center to the American Arbitration Association for the failure of the center to provide 2 percent raises to faculty teaching in the center’s outreach program. The arbitrator denied the employer’s assertion that the grievance was untimely, but found that the employer was not required to provide the raises to the outreach faculty that are mandated for the rest of the center’s faculty. The arbitrator ruled that the language of the CBA was sufficiently vague for him to take into account the employer’s testimony that it verbally indicated during negotiations that the raises would not apply to the outreach faculty.
