Meeting called to order at 11:08 AM. Present: Olcott, Recording Vice President O’Connor, Executive Board members Brandford, Burridge, Cranshaw, Dougherty, Hyde, Schwartz, Sharman, Assistant to the President Boyle. President Gagliardi excused on union business.
It was moved and seconded to approve the October 16 minutes as corrected. Motion carried unanimously.
Recording Vice President O’Connor announced that the number of candidates for Local 802 offices did not exceed the number of officer positions. In accordance with Local 802 Bylaws and Local 802 Executive Board policy, the following members are elected: President: Tino Gagliardi; Financial Vice President: Tom Olcott; Recording Vice President: John O’Connor; Executive Board: Jay Brandford, Bud Burridge, Bob Cranshaw, Sara Cutler, Patricia Dougherty, Martha Hyde, Gail Kruvand, Andrew Schwartz, Clint Sharman; Trial Board: Roger Blanc, Tony Gorruso, Susan Lorentsen, Eugene Moye, Madelyn Rubenstein, Steve Shulman, Bob Suttmann, Mary Whitaker; Delegates to the AFM Convention: Burridge, Gorruso, Hyde, Kruvand, Olcott, Sharman; Delegates to the New York City Labor Council: O’Connor, Olcott; Delegates to the New York State Federation of Labor: Hyde, O’Connor. Discussion held.
Executive Board member Burridge present at 11:27. President Gagliardi announced the Local 802 annual holiday party will be on December 19. Discussion held.
Gagliardi reported on New York City Ballet negotiations.
Gagliardi reported on a New York City Opera Labor Management Committee meeting.
Gagliardi presented an invitation to the New York State AFL-CIO Annual Labor Celebration on December 6. Discussion held. It was moved and seconded to purchase two tickets at $250 each and a half-page journal ad for $250. Motion carried unanimously.
Gagliardi reported on the release of a DVD release of the Broadway show “Shrek.” Discussion held.
Gagliardi reported that Local 802 officers will be meeting today with a representative of the LCO Group to go over the audit of the union’s IT system.
Gagliardi reported on a meeting with representatives of the Broadway League about a possible site for an Emergency Relief Fund gala in 2013. Discussion held.
Financial Vice President Olcott presented a request from the Bronx Arts Ensemble to use public service scales for a concert on October 25. It was moved and seconded to grant the request. Discussion held. Motion carried unanimously.
Local 802 Counsel Mars present. Gagliardi presented a memorandum of understanding (MOU) with Now’s the Time Productions, LLC for the New York City production of “How the Grinch Stole Christmas.” Discussion held. It was moved and seconded to approve the MOU with Now’s the Time Productions. Motion carried unanimously. Mars excused.
US Labor Against the War (USLAW) organizer Tom Gogan present. Gogan gave a presentation on USLAW. Executive Board member Cranshaw excused at 12:40. Discussion held.
Gogan excused. Executive Board recessed for lunch at 1:10. Executive Board reconvened at 1:48.
Local 802 Controller Camiolo present. Camiolo gave a presentation entitled Consolidated Financials Statements and Statement of Financial Position, June, 2012. Discussion held.
Executive Board member Brandford excused at 2:10. Executive Board member Hyde excused at 2:17. Camiolo excused. Recording Vice President O’Connor announced he will be attending Motion Picture and Television Film negotiations in Los Angeles from November 12 till November 16. Discussion held.
O’Connor reported on a labor action and picketing at BAM’s Harvey Theatre against Numinous Music for its failure to comply with the union’s demand to sign a single engagement contract for performances on October 19, 20 and 21. It was moved and seconded to pay Local 802 members hired by Numinous Music who honored the BAM picket line $540 each from the strike fund. Discussion held. Motion carried unanimously.
Discussion held on bringing charges against Local 802 members hired by Numinous Music who did not honor the picket line.
It was moved and seconded to put Numinous Music on the Unfair List. Motion carried unanimously.
Assistant to the President and Political and Public Relations Director Boyle reported on the presidential campaign of Barack Obama. Discussion held.

Meeting called to order at 11:05 AM by Financial Vice President Olcott. Present: Olcott, Recording Vice President O’Connor, Executive Board members Burridge, Cutler, Dougherty, Hyde, Kruvand, Sharman, Assistant to the President Boyle. President Gagliardi excused on union business.
President Gagliardi communicated by teleconferencing technology.
Gagliardi reported that Rock of Ages producers responded unfavorably to Local 802’s offer to waive certain contractual obligations due to circumstances stemming from Hurricane Sandy. Discussion held. It was moved and seconded to rescind the waivers granted to Rock of Ages producers at the November 1 Executive Board meeting in light of their rejection of the offers as being inadequate. Discussion held. Motion carried unanimously.
Financial Vice President Olcott presented a request from the Canterbury Choral Society to waive the seven day notice of cancellation requirement for a concert scheduled for November 3 due to circumstances stemming from Hurricane Sandy. It was moved and seconded to grant the request. Discussion held. Motion carried unanimously.
Olcott presented a request from the Orchestra of St. Luke’s to waive the seven day notice of cancellation requirement for a concert scheduled for November 4 due to circumstances stemming from Hurricane Sandy. It was moved and seconded to grant the request. Motion carried unanimously.
Olcott requested an annual increase for a non-bargaining unit Local 802 employee.
It was moved and seconded to grant the request. Motion carried unanimously.
Recording Vice President O’Connor distributed members comments forwarded by an Executive Board member regarding the labor action and picketing at Brooklyn Academy of Music’s (BAM) Harvey Theatre against Numinous Music for its failure to comply with the union’s demand to sign a single engagement contract for performances on October 19, 20 and 21. (See minutes of October 23.) Discussion held.
O’Connor reported on referral service developments. Discussion held.
It was moved and seconded to create scales for Legit 802, Inc./referral service demo recordings at $25 per hour with a two hour minimum, 12 percent pension and $15 per day health contribution for the purposes of electronically showcasing Local 802 member bands. Discussion held Motion carried. Kruvand opposed.
O’Connor requested that Local 802 send two representatives to the Jazz Education Network (JEN) Conference in Atlanta in January. It was moved and seconded to pay expenses up to $2,700 for a booth and two representatives to attend the JEN Conference. Discussion held. Motion carried unanimously.
Electronic Media Services Department Representative Sheldon present. Sheldon presented a Local 802 Limited Pressing Sound Recording Single Project letter of acceptance with Trinity Church for the Stravinsky Choral Works. Discussion held. Sheldon excused.
O’Connor presented requests for leaves of absence from six Broadway musicians. It was moved and seconded to approve the leaves. Discussion held. Motion carried unanimously.
Further discussion of Limited Pressing of the Stravinsky Choral Works. It was moved and seconded to approve of the Limited Pressing Sound Recording Single Project letter of acceptance with Trinity Church. Motion carried unanimously.

President Gagliardi, Recording Vice President O’Connor in Los Angeles to attend the Motion Picture and Television Film negotiations. Sharman taking minutes.
Olcott presented a request from Trinity Church to waive the 48 hour cancellation notice required by the Bylaws for a concert scheduled on November 29, 2012 and rescheduled for December 10, 2012 because of Hurricane Sandy. Discussion held. Motion made and seconded to approve the request. Motion carried unanimously.
Olcott presented a request from the Bronx Arts Ensemble to pay Public Service scale for a concert at Fordham University on November 15, 2012. Discussion held. Motion made and seconded to approve the request. Motion carried unanimously.
Olcott presented a request from Gemini Productions on behalf of Murray Sidlin to waive regular rehearsal rates for a Sunday night rehearsal at Avery Fisher Hall on April 28, 2013. Discussion held.
Theatre Business Rep Copeland present. Copeland presented an agreement with Diner Broadway, LLC for the developmental production of “Diner.” Discussion held. Copeland excused. Motion made and seconded to approve the agreement. Motion carried unanimously.
Discussion continued. Business Rep Pawlo present. Pawlo presented a Limited Pressing Agreement (LPA) with the Manhattan Theatre Club for the Off Broadway production of “Murder Ballad.” Discussion held. Pawlo excused. Motion made and seconded to approve the LPA. Motion carried unanimously.
Olcott presented requests for leaves of absence from two Broadway musicians. Motions made and seconded to approve the leaves. Motions carried unanimously.
Jazz/Education Representative Weeks present. Weeks provided a budget proposal and a request for $1,074.47 to be donated to the Council for Living Music to pay musicians for a demonstration parade for the Justice for Jazz Artists campaign to be held on November 14, 2012. Discussion held. Weeks excused. Motion made and seconded to approve the request. Motion carried unanimously.
Schwartz and Boyle reported on the progress of the Ninth Ave. parking meter campaign. Discussion held.
